LEGAL HELPERS ATTORNEY WINS CASE AGAINST MIAMI CREDITOR

The Miami, Florida, offices of Legal Helpers, a national consumer bankruptcy law firm, successfully enforced a bankruptcy stay as of July 2, 2009, against a creditor and its attorney, for failing to cease wage deductions following the filing of a Chapter 13 bankruptcy. This case has recently been made a published decision, Westlaw case #2009 WL 3378495 (Bkrtcy. S.D. Fla.).
The creditor in the case continued to garnish the paycheck of a Chapter 13 personal bankruptcy Legal Helpers client, post- bankruptcy filing, which is in violation of federal law. The attorney for the creditor, relying on a decision in a similar case, refused to stop the garnishment. Legal Helpers attorney, Adela Estopinan, filed an Emergency Motion, effectively forcing the creditor to return all funds seized and to impose sanctions. Following extensive legal research, two contentious court hearings and the submission of a detailed memo of law, the Legal Helpers lawyer prevailed. Monetary sanctions were awarded to the Legal Helpers client.
