Foreigners engaging in any of the three business structures must appoint a local manager to run the business. In the latest review of the Business Registration Act the Ministry of Manpower now deems it fit to require foreigners to seek for its prior approval in case they want to relocate to Singapore to actively participate in running the affairs of the business.

Asiabiz continues: “A foreigner or partners must first inform the Ministry of their plan before the business registration starts. Should they be granted a go signal, the application for an Employment pass shall take place.”

The application for necessary license takes place at Online Business Learning Service, an electronic registration system accessible by a Singapore Personal Access. Nonetheless, prior to applying for the necessary document, the location of the restaurant must first be secured, zoned for commercial use, and laid out in compliance with Code of Practice Utilities Board.

Asiabiz chimes that among other things, the restaurateur needs to secure permit from Public Utilities Board to install grease traps for the restaurant kitchen, otherwise, the restaurateur shall be fined by $$5,000 plus other serious penalty.

Utters Asiabiz: “The restaurant must also declare one food handler having records of typhoid inoculation, x-ray for tuberculosis, and must have completed a WSQ Basic Food Hygiene Course. All food handles are required to register with NEA.”

The license adopts a point system and its validity is determined by the accumulated points. Generally though, a license is valid for one year and if the points earned are12 and beyond, the license can be revoked.

Asiabiz warns: “Once the license is revoked, the restaurateur is not eligible to apply for another license.”
