A safeguarding or protecting system linked with the interstate identification index and national crime information center is the national instant criminal background check system. It is a way by which eligibility of a person to buy firearms can be checked. Or we can say a legal clearance of an individual is checked by the system to check whether the individual can buy the firearms or not.

There is a record maintained by national list of denial where people who have committed crimes, have been terminated in military services, have been issued warrants, or have a mental problem and also people involved with felonies or misdemeanors act are listed which provides information when needed and does not allow people with a bad track to get the ownership of guns.

The gun dealer is supposed to check the past record of the individual coming in to buy gun from the national instant criminal background check system. It can be checked from the system by a call made by gun dealer which gives quick information about the individual and is done generally for a rapid clearance or immediate selling. Sometimes the call is passed on to FBI or NICS (National instant criminal background check system) and can also be transferred over to an agent from customer care. According to the legal compliances, NICS has 3 days time to reply for the query and if in 3 Days NICS does not respond a gun dealer can sell the gun to the buyer.

The gun dealers can also access the information through internet if they have current technology and facilities. It takes jus fraction of seconds from internet to know whether the buyer can be sold a gun or not, but accessing information though internet is granted only on request and is only available for few states which has high technology. Internet accessing information from internet is still an undergoing process I many states and hence it is not widely available in every state.
At times it also happens that by mistake the transaction of selling gets over as it passes the 3 day lock in time an in that case to end up the sale or to get back the gun, legal action is required. But is not very easy as a sale transaction completed means that the knowledge of the gun dealer by which he sold the gun is true and the knowledge provided at the time of the contract is also true.

The law also says that the process of buying a firearm should not be very complex and it should be as easy to hold an arm for an individual to ensure his safety as every individual has a the right to feel safe. A complicated and stretched search would make the matter more complex for both the parties.

Any individual who could not buy the arm due to his past record or the request is declined by the system can appeal in the court through a pleading procedure and the result is entirely in the judge’s hand to allow or deny for the appeal. There are some merits and demerits of NICS and improvements are still going on to safeguard the safety and to protect the citizens of the country.
